Warranty
Once your landscape is installed, you will have the responsibility for caring for your plants and sod. Maintaining your new landscape is relatively simple. When your project is completed, you will be given a general plant care guideline and recommended program times for your irrigation system. You can refer to our tips and if you have any questions please call. We also routinely check properties after the landscape is installed and will advise you if we notice any irregularities. Should you start noticing plant decline such as wilting, leaf drop, discoloration, insect infestation, etc, call us immediately. This allows us to quickly determine possible causes of plant stress and recommend solutions.
Plants and sod are living and require proper maintenance and care to a varying degree. Occasionally plants will not survive the process of transplanting. Newly installed landscape plants can suffer transplant shock, particularly during the hot summer months. It’s imperative that plants receive proper care to minimize stress.
We will replace or credit all nursery stock supplied and installed by us that fail to survive for a period of 30 days from the date of invoice. Plants will only be replaced one time at no charge for materials and labor. Replacement plants are not warranted.
We warranty all sod sold and installed by us to be free from disease, sound and healthy at the time and date of installation and capable of living for a period of 30 days from the date of installation. We will make replacement of any such sod one time without any cost to the consumer, providing death occurs within the aforementioned 30 day period. The client shall provide the sod with all reasonable maintenance and proper care.
Plant materials that fail will be quickly replaced as our schedule permits. Reasonable growing conditions must be maintained as provision of the warranty, including automated irrigation, insect and disease control, and/or shelter from unreasonable damage by pets or pedestrians.
Warranties will be voided in cases of physical and/or chemical damage, neglect in watering or pest control, or in accounts over 30 days past due from date of invoice. All material is warranted to be as specified. All work is to be completed in a professional manner according to standard practices.
If Client currently has an Annual Contractual Landscape Maintenance Agreement with Synergy Landscape Group, we warranty the plants until the agreement discontinues.
General Policies & Conditions
Workmanship
All work will be performed in a professional manner by experienced personnel outfitted with the appropriate tools and equipment to complete the job properly. All work will be performed in accordance with current American National Standards Institute (ANSI) Standard Practices for Landscaping Operations.
Scheduling
Client is not required to be present at time of work. Upon acceptance of proposal Synergy Landscape Group has scheduling policies: scheduled projects and the scheduling efficiency option, Scheduled projects/jobs are a mutually agreed upon day and time. The scheduling efficiency option is when the project/job is worked into our schedule at our convenience, and the crew can show up announced, however an in route courtesy call is given.
Synergy Landscape Group reserves the right to delay performance of work; such right includes rescheduling for inclement weather and the expectation of inclement weather. Scheduled deliveries or products have not arrived on time due to unpredictable adjustments by manufacturer or vendor. Synergy Landscape Group will notify Client of the need to reschedule and is not responsible for any monetary loss resulting in delays or rescheduling the work. Client must notify Synergy Landscape Group within 72 hours to reschedule scheduled jobs.
Cancellation of the Work
Either the Company (Synergy Landscape Group) or Client may cancel the performance of the work at any time before the work begins, except that any cancellation on the part of the Client must be submitted in writing to Contractor/Company at least 5 days in advance. This applies to jobs scheduled by appointment and to jobs that are worked into our schedule. Should the Client cancel any work within 4 days or less, the Client shall pay a cancellation fee of $ 200.00 or 5% of the Total Project Cost, whichever is greater, within 5 days of cancellation.
Change Order(s)
Changes made to the project may result in added costs in material and labor. Revisions that change the price and/or scope of the project require a Change Order Form and client approval. Whenever a change is needed, whether a personal choice (Client says: “How about landscape lighting?”) OR Any Unforeseen Circumstances*, the Client will be provided with a Change Order in writing, to clearly identify such changes and their costs. Even if the change is a net difference of zero, the Client will be provided with a written copy.
*E.g. sinkhole, abandoned underground builder trash pits, unmarked utilities, drainage pipes and/or irrigation piping can cause a ‘Change Order’ to be placed.
Payment
A deposit is required for any project with a cost greater than $2,500.00. The deposit is half of the Total Project Cost, which is due on ‘Accepted Signature’ date. The remaining balance is due in full upon job completion (unless other written arrangements have been made) and there is no pay when paid basis accepted. In the notion that the Company (Synergy Landscape Group) and Client are agreed upon payment being mailed should be sent to P.O. Box 2877, Cumming, GA 30028 within 5 days of job completion. Any payments due hereunder and unpaid after 15 days of work completion is considered delinquent shall bear interest from the date the work was completed at the rate of 5% per month. A lien will be placed on the property for the unpaid amount including interest on delinquent accounts. Company will be entitled to any and all interest, collection fees, and/or attorney’s fees and costs incurred to collect any unpaid balance.
Payment Collection Terms
Additionally, in the event any payments due and payable by the Client remain outstanding fifteen (15) days after the delinquent date thereof, all services of Synergy, may, in Synergy’s sole discretion, be suspended until all payments have been remitted. Any and all attorney fees and expenses, including, but not be limited to, the filing of liens, use of collection agencies and any or all other methods necessary to collect any unpaid balance, incurred by Synergy to enforce the terms of this Contract shall be Client’s sole responsibility. If said amount falls under small claims guidelines, Company (Synergy Landscape Group) and Client both agree to settle in Hall County (Georgia) Magistrate Court. If said amount is greater than $15,000, both said parties agree Binding Arbitration in Hall County (Georgia).
Precautions
The Client and all others under his/her control specifically assume all risk of personal injury if he/she chooses to be anywhere near the proposed project on the property during the performance of the work. The Client should avoid parking any vehicles or any other objects in the work area. In the event that the project is delayed or has to be rescheduled because of this, either a fee of $ 300.00 per hour that the job is delayed or $ 350.00 rescheduled trip charge will incur. Synergy Landscape Group strives to do as low impact work as possible and utilizes low impact equipment. It is impossible to determine tire marks, scruffs, load-bearing capabilities of your driveway/walkway due to age, thickness, or quality of workmanship. Synergy Landscape Group and/or it’s Subcontractors are not liable for any damage that may result from the use of equipment or manpower in the performance of the work, including but not limited to: driveway damage, cracking, scraping of pavement, damage to turf, ground cover, shrubs, or other vegetation, settling of hardscapes, unmarked or improperly located utilities, water, underground animal containment systems, gutter drainage pipes, propane tanks/lines and/or sewer lines.
Authorization
Written authorization of the contract for Synergy Landscape Group to perform the agreed upon work is subject to the policies and conditions listed above.
